fee structure

The fees set out overleaf will be earned by EPC in the event of them being instrumental either directly or indirectly in introducing a person who exchanges contracts to purchase the Freehold or Leasehold interest of the mentioned property.

NOTE: The property referred to overleaf under the heading "The Property Address" will be herein after referred to in this document as the "property".

The Vendor shall, on payment of the commission to EPC, indemnify Essex Property Centre against any claim for commission by any other Estate Agency with whom the Vendor may have had dealings in connection with the property.

If the sale, subject to contract, shall be negotiated by any other Estate Agency, the Vendor shall without delay and in writing inform Essex Property Centre of the fact and of the date and time thereof; otherwise the property shall in circumstances of conflicting claims for commission, be deemed to have been introduced by Essex Property Centre.

period of sole agency

Essex Property Centre are instructed as sole agents for a minimum period as specified over and from the date set out over. In the event of another Estate Agent being instructed to sell the property after the period of sole agency has expired, or instructed during the period of sole agency then our multi-agency fee specified over becomes payable.

The Sole Agency specified period will be deemed to be continuing after the expiration of the specified period as over until cancelled in writing by either the Vendor or Essex Property Centre.

meaning of sole agency

The Vendor will be liable to pay remuneration to Essex Property Centre in addition to any other costs or charges agreed if at any time unconditional contracts for the sale of the above property are exchanged or conditional contracts become unconditional:

  1. With a purchaser introduced by us during the period of our sole agency or with whom we have had negotiations about the property during that period or
  2. With a purchaser introduced by another Agent during that period.

private sales

Should the property mentioned overleaf be sold privately then Essex Property Centre reserve the right to know the name and address of the buyer together with the name and address of the Solicitors or Legal Representative acting on behalf of both the Vendor and Purchaser. If this information is not forthcoming then commission as mentioned over will be liable to be paid on exchange of contracts of this sale. Where an Essex Property Centre board is erected at the property, then our commission as stated over would become payable and any contract for sale shall be deemed to have resulted from Essex Property Centre Services introduction.

payment of fees

In the event of our fees not being received by Essex Property Centre within seven days of the completion of the sale then interest at a rate of 4% above the prevailing Lloyds Bank Base Rate would become payable in addition to and calculated on the fees outstanding. Therefore please ensure that if payment is made by your Solicitor or Legal Representative, that payment is made within these Terms of Engagement.

other services

Essex Property Centre reserve the right to offer additional services to any prospective purchaser or to any other seller or purchaser involved within a chain of sales with this property:

  1. To offer insurance and mortgage services
  2. To value the purchaser's property (or any other in the chain of sales)
  3. To offer for sale the purchaser's property (or any other property in the chain of sales)
  4. To carry out a survey on the purchaser's property (or any other in the chain of sales)
  5. Or to offer any of the above services via any connected persons of this Estate Agency.

Disclosure of interest

The Estate Agency Act 1979 provides amongst other matters that anyone engaged in the Estate Agency Work, or their relatives, or associates, must disclose their interest in any property dealings they are undertaking, therefore your attention is drawn to item 4 on the front of this document.
